Terms of service

1. Your account

To use SmarTest you create an account using your school email address. Each account is for one person. Do not share your login credentials; if you need to give a colleague access to the same papers, use the workspace sharing features instead.

You are responsible for activity on your account and for keeping your login secure. Tell us immediately at security@smartestmaths.ie if you think someone else has signed in as you.

2. Your content

Papers, figures, marking schemes, notes, and anything else you create in SmarTest (your “content”) belong to you. We never claim ownership of it.

You grant SmarTest a limited licence to store, display, and process your content solely to provide the service to you and to anyone you share it with inside your workspace. This licence ends when your account is deleted, save for the 30 day recovery window described in the privacy policy.

You are responsible for the content you put into SmarTest. Do not upload material you do not have the right to use. If a third party claims your content infringes their rights, we may remove it while we investigate.

3. Payment and plans

SmarTest offers a free tier and paid plans. Current pricing is on the pricing page.

• Paid plans bill monthly or annually in advance via Stripe.
• You can cancel a paid plan at any time from your billing page. Cancellation takes effect at the end of the current billing period.
• Annual plans are refundable on a prorated basis within the first 30 days; after that they run to term.
• If a payment fails, we email you and retry for 7 days before downgrading the account to the free tier. Your content stays intact.
• Prices are exclusive of VAT. VAT is added at the applicable rate at checkout.

4. Acceptable use

SmarTest exists to help teachers author high quality mathematics assessments. The following uses are not permitted on any plan.

• No cheatingSmarTest is a teacher tool. Do not use it to generate work to be submitted by a student as their own, or to circumvent an examination body's rules on candidate-generated material.
• No illegalDon't use SmarTest for anything illegal, harassing, or deceptive. Don't upload content that infringes copyright, exposes private data, or violates the Children First Act.
• No scrapingDon't scrape, crawl, or rate-bomb the service; don't use automated tools to extract content or generate load beyond normal human use.
• No resaleSmarTest is licensed for use by the account holder and their workspace. Don't white-label, resell, or package the service into another product without a written agreement.
• No reverseDon't attempt to reverse-engineer the product, extract its models, or access parts of the system you have not been granted access to.
• No abuseDon't target another user of SmarTest, harass support staff, or attempt to disrupt the service for others.

Violations can lead to warnings, temporary suspension, or termination without refund. We apply these rules in good faith; if you think we have got it wrong, email appeals@smartestmaths.ie.

5. Cookies

SmarTest sets one cookie: an essential session cookie that keeps you signed in. We do not run analytics, advertising, or third-party tracking cookies. Because we only use essential cookies, there is no cookie banner.

6. Availability

We aim for 99.9% monthly availability outside scheduled maintenance. Scheduled maintenance is announced in-app at least 48 hours in advance and kept outside school working hours where possible.

If the service is materially degraded for longer than 8 hours in a month, paid customers receive a prorated service credit on request.

7. Termination

You can delete your account from the account settings page at any time. We give you 30 days to reverse the decision before content is permanently deleted.

We can suspend or terminate an account if it violates these terms, if payment fails for longer than 30 days, or if we are legally required to. Where practical, we give notice and a chance to fix the issue first.

8. Warranties and disclaimers

We provide SmarTest “as is” and make no warranties that the service will always be error-free, uninterrupted, or fit for a specific purpose beyond the ones described on our marketing pages. Mathematical content generated or assisted by SmarTest should be reviewed by a qualified teacher before being put in front of students; SmarTest is an authoring tool, not a replacement for teacher judgement.

9. Limitation of liability

To the maximum extent permitted by Irish law, SmarTest's total liability to you under these terms is limited to the fees you paid for the service in the 12 months preceding the event that gave rise to the claim. Neither party is liable for indirect, incidental, consequential, or loss-of-profit damages.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by law.

10. Governing law

These terms are governed by the laws of Ireland. Disputes are subject to the exclusive jurisdiction of the Irish courts. If you are a consumer resident in the European Economic Area, this does not deprive you of the protections of your local consumer law.

11. Changes to these terms

When we make material changes we notify account administrators by email at least 14 days before the change takes effect, and we post the new version here with a new effective date. If you do not agree with a change, you can cancel your account before it takes effect and we will refund any prepaid, unused period.
